Terms

Terms. The contract between you and Tobos.

We wrote these terms to be read: if anything is unclear, write to hey@tobos.ai.

Who we are

Tobos FlexCo, Seitenstettengasse 5/37, 1010 Wien, Austria, commercial register FN 685522 x, VAT ID ATU83595824 ("we"). E-mail hey@tobos.ai, phone +43 677 61464395. This is also our contact point for users and authorities under the Digital Services Act (Art. 11 and 12) and for removal orders under Regulation (EU) 2021/784, in English or German.

These terms apply to every Tobos account, Free or Pro, and to buying Pro. A business’s own terms don’t apply. The contract language is English.

What Tobos is

With Tobos Present, you make presentations as code: you, or the coding agent you work with, write a deck with our command-line tool, tobos (the CLI). Each deck is a git repository on our server. We check and compile it, store its media, and show it in the browser: a live preview, a presenter view and an audience window. You can export a deck as a PDF. We never run a deck’s code on our servers; it runs in the browser of whoever views the deck.

There are two plans. Free costs nothing and includes 3 hosted decks, 2 templates of your own (your house styles) and 1 GB of media, with files up to 100 MB. Pro costs €12 a month and lifts this to any number of hosted decks and templates and 10 GB of media, with files up to 500 MB. On every plan, a deck’s npm packages can take up to 200 MB installed and 20 MB sent to viewers. When you reach a limit, we refuse what goes beyond it; we delete nothing.

You need Node.js 22.18 or newer and git for the CLI, and a current browser. To render or export a deck, the CLI uses your Chrome or Edge, or downloads Chromium once if there is none. Deck links expire after at most 24 hours.

Your account

You sign up by logging in: enter your e-mail address in the CLI or at app.tobos.ai, and we e-mail you a code. The first code you use, yourself or through your agent, creates your account and with it this contract. The e-mail and the login page say so, and link to these terms.

You must be at least 16. To buy Pro, you must be 18, or have a parent’s consent. The e-mail address must be your own, and an account is for one person.

Keep your login codes and the CLI’s token secret: whoever has them can act as you. What your coding agent does with your account counts as done by you, so decide what you let it do. If you think someone else is using your account, tell us straight away.

Your content

Your decks, with their code, media and notes, are yours. You need the rights to everything you put in them, including images, fonts, video and npm packages, and you must follow their licences.

You give us permission, without payment, to store, copy, back up, check, compile and convert your content (for example into a PDF), and to show it to you and to anyone who opens a deck link to it. We use this permission only to provide Tobos to you. It ends when your content is deleted; for backups, when they expire (see the privacy policy).

We don’t look at your decks unless you ask us to, we are handling a report or an order from an authority, or security requires it.

A deck link works for anyone who has it until it expires, and shows the whole deck, including its notes. Share it only with people who should see the deck.

You may use Tobos standard, our built-in house style, and anything you build from it in your decks, also after you leave Tobos.

Every deck is a git repository: a clone holds its code and notes, but not its media files. Keep your own copies of those.

If your decks contain other people’s personal data, you must be allowed to use it. If you are a business, our data processing agreement at tobos.ai/dpa is part of these terms, and we process that data only on your behalf.

What you may not do

Don’t use Tobos to:

  • store or show illegal content, such as child sexual abuse material, terrorist content, incitement to violence or hatred, defamation, or content that infringes someone else’s rights;
  • write deck code that harms viewers or others, such as malware, phishing, cryptocurrency mining, tracking viewers, or getting around the browser’s protections or our checks;
  • use it as general file hosting: media is for your decks, not for downloading or embedding elsewhere;
  • attack, overload, probe or scrape Tobos, or get around its limits, for example with several Free accounts;
  • resell or rent out Tobos without our agreement.

If you find a security problem, tell us at hey@tobos.ai. We take no action against research done in good faith that respects other people’s data and goes no further than needed to show the problem.

Reports and moderation

We don’t monitor content in general.

Reporting illegal content. Anyone can report content they think is illegal by e-mail to hey@tobos.ai. Please include the link to it (an expired link is fine), why the content is illegal, your name and e-mail address (not needed if the report is about the sexual abuse or exploitation of children), and a statement that you believe in good faith that the report is accurate and complete. We confirm receipt, decide carefully and without undue delay, and tell you our decision and how you can challenge it.

How we decide. Our checks apply the deck format and the plan limits automatically: a push that doesn’t compile or goes over a limit is refused, with the reason. Whether content is illegal or breaks these terms, a person decides; we use no automated tools for that.

What we may do. Depending on how serious the case is, we remove a deck or a file, or suspend or close the account. We act carefully, objectively and in proportion, with regard to everyone’s rights, including freedom of expression. We warn you first, unless the content is clearly illegal or the matter is urgent. We tell the police or prosecutors about threats to someone’s life or safety.

Terrorist content is not allowed. We remove it as soon as we learn of it, and if an authority orders us to remove it, we do so as the law requires.

Reasons and complaints. If we restrict your content or account, we e-mail you what we did, why, on which ground, and how to challenge it. To challenge it, reply within six months: we look at the decision again, and tell you the result and our reasons. You can also go to court at any time.

Changes to Tobos

We take care to keep Tobos running, but maintenance and faults can interrupt it. We announce planned maintenance where we can.

We keep developing Tobos and may change it for one of these reasons: security, a change in the law or a decision of a court or authority, a change by one of our providers, to keep it working with new versions of the software it relies on, or to add or improve features. A change never costs you extra. If a change makes Pro more than slightly worse for you, we e-mail you at least 30 days ahead what changes and when. You can then end Pro at once, free of charge, within 30 days after the e-mail or the change, whichever is later, and we refund the unused part of the month.

Buying Pro

You buy Pro at app.tobos.ai/billing. The page shows what Pro includes and costs; you accept these terms and click "Buy now", which places your order. You then pay on Stripe’s page. We accept your order, and the contract is concluded, when your payment goes through. We confirm it by e-mail, with these terms and the withdrawal information.

Before you click "Buy now", you can check everything and go back; on Stripe’s page, you can correct your details until you pay. We store the terms you accepted; the confirmation e-mail contains them, and we send them to you again on request.

Pro costs €12 a month, VAT included where it is due. Businesses in other EU countries that give their VAT ID pay €12 without VAT (reverse charge). Your invoice shows the VAT.

You pay monthly in advance, through Stripe, by card or with Link, Stripe’s service for saved payment details. Your invoices are at app.tobos.ai/billing, under "Manage billing".

If a payment fails, Stripe tries again over the following days and tells you by e-mail. You keep Pro meanwhile. If the payment still fails, Pro ends, your account goes back to Free, and you owe us nothing for that month.

We change the price only if you agree. We e-mail you a new price at least six weeks before it would apply and ask whether you accept it; silence is not acceptance. If you don’t accept it, Pro continues at the old price until you or we end it.

Cancelling Pro

Pro runs month by month, with no minimum term, until you or we end it.

You can cancel at any time: at app.tobos.ai/billing under "Manage billing", with "Cancel contracts here" at app.tobos.ai/cancel, or by e-mail to hey@tobos.ai saying which account it is. Pro then runs to the end of the paid month, and you pay nothing more. After that, your account goes back to Free and nothing is deleted: decks beyond Free’s limits stay available, but you can’t add new ones until you are within the limits.

You can also cancel for an important reason. If it holds, Pro ends when we receive your cancellation, and we refund the unused part of the month.

14 days to withdraw

You can withdraw from the contract for Pro within 14 days after the day it is concluded, without giving reasons, and we refund everything you paid for it. This holds for consumers, as the law requires, and for businesses too.

Use "Withdraw from contract here" at app.tobos.ai/withdraw, or tell us in any other clear way. We then end Pro and refund everything you paid for it. A withdrawal sent after the 14 days counts as a cancellation. The full instructions and a withdrawal form are at tobos.ai/refunds, and in the e-mail confirming your purchase.

After the 14 days, we don’t refund the rest of a month when you cancel, except where these terms say otherwise. We refund in full anything we charged by mistake.

Deleting your account

To delete your account, write to hey@tobos.ai, saying which account it is. If you have Pro, we delete the account when the paid month ends, or at once if you ask for that. We delete the account and its decks within 30 days; the privacy policy says what we keep, and for how long. Before that, clone your decks and keep copies of your media.

When we can end it

We can end Pro by e-mail with at least one month’s notice, at the end of a paid month, for example if we stop offering it. We can end a Free account by e-mail with two months’ notice.

We can suspend or close an account at once only for a serious reason: you store illegal content; you deliberately attack or overload Tobos or other people; you seriously or repeatedly break the rules above; or an authority orders it. Where suspending is enough, we suspend rather than close, and we always tell you why. If we close an account with Pro, we refund the unused part of the month. Within 30 days after we close it, you can ask us for a copy of your decks and media, apart from illegal content.

Warranty and liability

You keep your statutory warranty rights.

If you are a consumer, we are liable for damage we cause intentionally or through gross negligence, for personal injury, and under the Product Liability Act. For other damage caused by slight negligence, we are not liable.

If you are a business, we are liable without limit for intent, gross negligence and personal injury, and under the Product Liability Act. For slight negligence, our liability is limited to what you paid us in the twelve months before the damage, and we are not liable for lost profit, indirect damage, or lost data beyond the cost of restoring it from your copies.

Changes to these terms

We change these terms only if you agree. We e-mail you the change at least six weeks before it would apply and ask whether you accept it; silence is not acceptance. If you don’t accept it, these terms stay, and we may end the contract as described under "When we can end it".

Law and disputes

Austrian law applies. If you are a consumer, you also keep the protection of the mandatory law of the country where you live.

If you are a business, the competent courts in Vienna, Austria, have exclusive jurisdiction.

We have not committed to consumer dispute resolution. If we can’t settle a complaint with you, we tell you the competent body, usually the Internet Ombudsstelle (ombudsstelle.at), and whether we will take part.

Contact
